Zoning Petition Withdrawn

According to Attorney Robert Lutz, M & J Limited Partnership withdrew its variance petition from the Speedway Board of Zoning Appeals.  The partnership was seeking a variance to avoid making the abandoned Conrail railroad right of way  a commercial parking lot for cars during IMS racing events. Zoning regulations would have required the owners to zone the property as a commecial lot to qualify for a road cut onto Crawfordsville Road.

The issue developed when the town council approved in a 3-2 vote to allow Jerry Brattan to put in a road cut.

Lutz did not give specifics as to why the petitioner sought to withdraw the petition. The BZA had continued the issue for August 1 after they observed parking for the Brickyard event.
